Personal Information
Agenda Personnel Pty Ltd is committed to protecting your personal information and will only use your personal information for the purposes of placing you in employment. We will only refer your information to clients with your knowledge and permission.
Prior to being placed in employment you have a right to access your personal information held by us and if necessary to have that information corrected, updated or made more complete. Once you are successful in obtaining employment, your personal information becomes part of our employment records or those of our clients. Employment records are governed by industrial legislation and are the property of Agenda Personnel Pty Ltd.
If you are employed by Agenda Personnel on a temporary placement, your personal information becomes part of our employment records. As your employer, we are prepared to answer any questions you may have with respect to your records.
What is Personal Information?
Personal information is any information or opinion (whether true or not) concerning you and your employment history. Personal Information includes your contact details, references, opinions about your work experience or performance, results of occupational or psychological testing and any other information obtained by Agenda Personnel Pty Ltd in seeking to place you in appropriate employment.
Personal information may include sensitive information. Sensitive information is information or opinion about your racial or ethnic origin, political opinion, membership of a political association or religious beliefs, affiliations or philosophical beliefs, membership of a professional or trade association or membership of a trade union, sexual preferences or practices, criminal record, health or disability (at any time), expressed wishes about the future provision of health services, etc. Sensitive information can, in most cases, only be disclosed with your consent or if required by law.
How personal information is collected.
We obtain most of our information from you directly:
- When you submit a resume.
- When you will out our registration forms.
- During an interview.
- Each time we have contact with you.
We also receive indirect information about you when we:
- Receive any reference about you.
- Receive feedback from your former employers, work colleagues, professional associations or registration body.
- Receive performance feedback.
- Receive any complaint from or about you in the work place.
- Receive any information about a workplace accident in which you are involved.
- Receive any information about any insurance investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you are involved.
- Certificates of educational qualifications.
If we have not already done so, when or before we collect information, we will take reasonable steps to inform you of the purpose for which the information is collected, where applicable, any law requiring information to be collected and the main consequences if all or part of the information is not provided.
How your personal information will be used.
Your personal and sensitive information may be used in connection with:
- Your potential employment.
- Your performance appraisals.
- Our assessment of your ongoing performance and prospects.
- Assessment of medical competency and psychological testing.
- Our identification of your training needs.
- Any workplace rehabilitation.
- Our management of any complaint, investigation or inquiry in which you are involved.
- Any insurance claim or proposal that requires disclosure of your personal or sensitive information.
- Identifying potential new clients.
Who will this personal information be disclosed to?
Your personal and sensitive information may be disclosed to:
- Potential and actual employers and clients of Agenda Personnel Pty Ltd.
- Insurers.
- Professional associations or registration bodies that have a proper interest in the disclosure of your personal and sensitive information.
- Your referees, former employers, work colleagues, professional or representative organisations, employment or labour hire agencies.
- A Workers Compensation body.
- Any person with lawful entitlements to obtain the information.
If you are employed in a temporary contract position, we will require you to provide your tax file number in order that we may pay you and deduct the relevant tax.
What happens if you do not give us the information we seek?
We may be limited in our ability to locate suitable work for you and we may be limited in our ability to place you in a position.
Data Quality
The personal information obtained from you at the time of your initial contact and interview with Agenda Personnel Pty Ltd is assumed to be accurate, complete and up to date. If at any time you believe your personal information is no longer accurate, complete or up to date, please advise us accordingly.
Data Security
Agenda Personnel Pty Ltd will take reasonable steps to protect your personal information from misuse, loss or unauthorised access. We hold your personal information in computers and paper based files and other records at Agenda Personnel Pty Ltd's office. Premises are secured by lock and key and computer records are secured by password access and paper based files are secured under lock and key when the office is unattended. We destroy your personal information when no longer needed for placing you in a position.
Your right to access your personal information.
You have a right to access and to obtain a copy of your personal information. However, there are exemptions to this right of access. We are not required to provide you with access where a request:
- Is after you have become an employee of Agenda Personnel Pty Ltd.
- Is frivolous or vexatious.
- Concerns information relating to an existing or anticipated legal proceeding between Agenda Personnel Pty Ltd and an applicant.
- Would reveal our intentions in relation to negotiations with you in such a way that it would prejudice those negotiations
- Requires access that would be unlawful.
- Would be like to prejudice the prevention, investigation and prosecution of any criminal offence or seriously improper conduct.
If you are able to establish that personal information about you that we hold is not accurage, complete and up-to-date, we will take reasonable steps to correct it. If we are unable to agree that personal information that we hold about you is accurate, you will need to provide statements to prove what you say is correct. If you wish to exercise your right of accessing correction, you should put a written request to our Managing Director.

By reading this statement and submitting your details to us, you are deemed to have accepted our Privacy Statement. Your consent allows us to disclose or use your information for any reasonable purpose related to your possible employment as set out within this policy statement. Furthermore, we have a public interest duty to cooperate with law enforcement agencies and to prevent any threat to life, health or safety of any person, and may have to disclose your personal information in such circumstances.
