AGENDA'S PERMANENT AND TEMPORARY TERMS AND CONDITIONS OF BUSINESS

Here are some of our temporary and permanent terms and conditions for placement. Please contact your consultant at Agenda for a copy of the full terms and conditions.

TEMPORARY PLACEMENT

Terms and Conditions of Business

  • Temporary staff are engaged for a minimum of four hours on any given day. In the event that a Temporary is employed for less than four hours, then the minimum billing of four hours shall apply.
  • Rates charged are inclusive of WorkCover, superannuation, leave provisions, recruitment, termination, and administrative costs. GST is charged in addition to the hourly rate.
  • Charges are made only for the actual hours worked by the Temporary Employee. There are no charges for sick leave or time off.
  • Should the Client wish to appoint an AGENDA PERSONNEL Temporary employee to your permanent staff or that of an associated company or other employment agency/consultancy whilst working on, or during the 12 months following the completion of an assignment, a placement fee will be payable by the Client based on our standard permanent fee structure. A guarantee does not apply to a temporary to permanent placement if the temporary/contract period was longer than 90 days.
  • If a Temporary Employee is unsuitable and AGENDA PERSONNEL is notified within the first 4 hours of the assignment, there will be no charges incurred for that Temporary Employee and a replacement will be provided.
  • The Temporary Employee shall be under the direction and control of the Client from the time of commencement of duties for the duration of the arrangement. The Client is responsible for providing a safe working environment for the Temporary Employee, ensuring that appropriate procedures exist for the control of the Temporary Employee including suitable security and insurance levels.
  • AGENDA PERSONNEL'S liability to the Client shall, subject to any specific contrary statutory provision, be limited to the fees paid for the Temporary Employee by the Client.
  • Testing and reference checking are carried out as far as practical. AGENDA PERSONNEL agrees to make every reasonable effort to ensure the suitability of applicants on behalf of our Clients.
  • When a candidate previously employed on a temporary/contract basis is subsequently employed on a permanent basis, the temporary/contract period will be deemed to be the guarantee period if the temporary contract was longer than 90 days.

PERMANENT PLACEMENT

Terms and Conditions of Business

  • Acceptance of a candidate from AGENDA PERSONNEL shall be deemed acceptance of AGENDA PERSONNEL'S Terms and Conditions.
  • AGENDA PERSONNEL fees are calculated as a percentage of the total salary package paid in the first year of employment. The total salary package includes wages, superannuation, incentives, commission, bonuses and allowances.

    FEE STRUCTURE 1

    100% fee upon the acceptance of an offer by the candidate.

    FEE STRUCTURE 2

    1/3 of the total estimated fee upon acceptance of the assignment.
    1/3 of the total estimated fee package upon presentation of shortlisted candidates.
    The balance is payable upon the acceptance of an offer by the candidate.
  • Where a candidate is employed by the Client for a fixed contract period and that contract period is less than twelve months, a proportionate amount of the permanent placement fee based on the contract period shall be due and owing. For example, if a contract is for three months, a quarter of the permanent placement fee shall apply. Where the contract is six months, half of the permanent placement fee shall apply. If the contract is extended, a further fee will be charged, ie. If the contract is extended past twelve months the remainder of the full fee will be charged.
  • AGENDA PERSONNEL'S guarantee periods are in accordance with the fee structure and will be 90 days, from the commencement date of placement. If you are dissatisfied with the placement of the candidate or the candidate leaves on her/his own accord, during the guarantee period, a replacement will be found. AGENDA PERSONNEL must be advised immediately upon the cessation of the candidate for the above to apply.
  • Testing and reference checking are carried out as far as practical. AGENDA PERSONNEL agrees to make every reasonable effort to ensure the suitability of applicants on behalf of our Clients.
  • Should the Client wish to appoint a candidate who has been referred by AGENDA PERSONNEL PTY LTD within 12 months of that referral a full placement fee will be payable by the Client.
